2. Licence to use website
Most loans taken out in the UK are regulated by the Consumer Credit Act (CCA). The Act stipulates that CCA regulated loan agreements must be properly executed and they must contain a number of terms. Several are prescribed terms which must a) be present and b) be accurate.
Failure to adhere to the regulations leaves the agreement vulnerable to potential unenforceability. In fact, with agreements taken out prior to April 6th 2007, the Courts have no discretion but to rule an agreement unenforceable should it either a) fail to contain all of the prescribed terms, and/or b) contain any prescribed terms which are inaccurate.
Due to failings by the banks, a huge number of loans could contain breaches (usually through missing or inaccurate information) meaning they would be unenforceable of challenged in a court of law.
